Terms of Use

Please read these terms before using Raily AI Scoring. Raily LLC provides the Service; Credits may be sold and billed separately by TEMNIKOVA LDA.

1. Acceptance of Terms

These Terms govern access to the Raily AI Scoring platform, website, APIs, extension and connected channels (the "Service"), provided by Raily LLC ("Raily", "we", "us" or "our"). Where the Service asks you to submit an analysis or buy Credits, you must affirmatively accept the then-current Terms and Privacy Policy. We may record their versions, the time, the account or wallet, and the action. Material changes may require renewed acceptance.

2. Description of Service

The Service provides probabilistic, AI-assisted psychometric models from photographs or supplied profile data, with visualizations and narrative interpretations for non-consequential informational use. Outputs are estimates, not verified facts about an identified person. Features may include saved reports, comparisons, Matching, chat, notifications, public-profile imports, connected channels, prepaid Raily Credits and recurring subscriptions. The Service is provided on an "as available" basis.

3. Not a Medical or Professional Diagnosis

The Service is strictly for informational and educational purposes. It is NOT a medical device, clinical diagnostic tool, or professional psychological assessment. You must NOT use the Service for:

  • Clinical diagnosis or treatment decisions
  • Forensic or judicial determinations
  • Employment hiring, firing, or promotion decisions
  • Individual threat assessment or security clearance decisions

4. Photo Uploads — Data Handling

When you upload photographs for analysis:

  • Photos are not retained after analysis. While processing is underway, a separate encrypted recovery copy exists only so an interrupted analysis can resume. It is deleted when processing finishes; if a technical failure prevents that, an automatic safety limit deletes it no later than 6 hours after upload.
  • Raily does not use uploaded photographs to train or improve its own models. Provider processing is limited to delivering the requested analysis and is described in our Privacy Policy.
  • Photos are transmitted to Raily Merlin for feature extraction. Raily deletes its live encrypted input when processing becomes terminal or the input expires; Merlin does not receive an account name or a verified real-world identity from Raily.
  • You may upload only material that you are legally entitled to use for this purpose. You are responsible for obtaining any rights, licences or permissions required for your upload. A public source does not remove that responsibility.

5. AI Transparency and Use Boundaries

The Service uses statistical and AI systems subject to the following boundaries:

  • The Service uses AI systems that generate outputs based on statistical patterns. Results are probabilistic estimates, not factual determinations about a person.
  • Raily is designed only for non-consequential informational use. You must not use outputs to make employment, credit, insurance, housing, healthcare, education-admission, law-enforcement, migration, judicial, threat-assessment or security-clearance decisions about a person.
  • Legal classification depends on the feature, market and actual use. These restrictions do not by themselves establish regulatory classification or compliance. You remain responsible for using the Service lawfully and within these boundaries.

6. Acceptable Use

You agree not to: (a) use the Service unlawfully or for a prohibited consequential decision; (b) upload material unless you have the rights, licences and permissions required for the upload and requested analysis; (c) imply that a display label is a verified identity; (d) reverse-engineer, decompile or extract source code except where law permits; (e) use the Service to build a competing product; or (f) overwhelm, disrupt or abuse the Service. We may suspend access for a material violation.

7. Intellectual Property

Raily LLC owns the Service, including its code, design, algorithms and visualizations. You retain ownership of content you submit and grant Raily a non-exclusive, worldwide, royalty-free licence, limited to the duration and purposes necessary to host, encrypt, transform, transmit and display it to operate, secure and support the Service, comply with law and enforce these Terms. If you use the Service for an organisation, you represent that you have authority to bind it. Organisational use remains subject to the prohibited consequential-use restrictions.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF DEALING. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RAILY LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED QATARI RIYALS (QAR 100). NOTHING IN THESE TERMS EXCLUDES LIABILITY OR REMEDIES THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

10. Indemnification

You agree to indemnify, defend, and hold harmless Raily LLC and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any other person or entity; (d) any content you submit through the Service.

11. Refunds

Raily LLC provides the Service. Raily Credits may be sold and billed in its own name by TEMNIKOVA LDA, an independent payment and distribution partner, which may appear as the seller or billing entity on receipts and statements. Stripe processes card payments; Raily does not receive full card details. Prices, taxes, renewal terms and cancellation controls are shown at checkout or in the billing portal. Credits are charged only for the successful result described at purchase. Used Credits are not refundable except where mandatory law requires otherwise. For unused Credits, billing errors, cancellation, refunds or chargebacks, contact [email protected]; Raily will handle the request and coordinate any payment action with TEMNIKOVA LDA. A refund or chargeback may revoke the corresponding unused Credits.

12. Termination

We may suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including without limitation if you breach these Terms. All provisions of these Terms which by their nature should survive termination shall survive, including ownership disclaimers, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Qatar, without regard to conflict-of-law rules, and disputes are subject to the courts of Doha, Qatar. This choice does not remove any mandatory consumer protection, forum or remedy that applicable law does not allow you to waive.

14. Changes to These Terms

We may update these Terms prospectively by posting a revised version and effective date. We will provide reasonable notice of material changes and may require renewed affirmative acceptance. Continued use alone will not replace renewed acceptance where applicable law requires it.
