Terms of Use

Please read these terms carefully before using ai-scoring. By accessing or using the Service, you agree to be bound by these Terms of Use.

1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the ai-scoring platform, website, and APIs (collectively, the "Service"), provided by Raily LLC ("we", "us", or "our"). By accessing or using the Service in any manner, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not use the Service.

2. Description of Service

The Service provides AI-assisted personality trait analysis from photographs or personality profile data. It generates scientific scoring visualizations, behavioral insight reports, and LLM-generated narrative interpretations across three application domains: Business, Government, and Education. The Service is provided free of charge on an "as available" basis.

3. Not a Medical or Professional Diagnosis

The Service is strictly for informational and educational purposes. It is NOT a medical device, clinical diagnostic tool, or professional psychological assessment. You must NOT use the Service for:

  • Clinical diagnosis or treatment decisions
  • Forensic or judicial determinations
  • Employment hiring, firing, or promotion decisions
  • Individual threat assessment or security clearance decisions

4. Photo Uploads — Data Handling

When you upload photographs for analysis:

  • Photos are never stored on our servers. They exist only in transient memory during processing and are discarded immediately after the analysis completes.
  • Your photos are NOT used for machine learning training, model improvement, or any purpose other than generating your individual analysis.
  • Photos are transmitted to our analysis partner (Merlin/RAILY API) for facial feature extraction. This third-party processor handles your photos under its own data processing obligations.
  • You upload photos entirely at your own risk. We are not liable for any interception, misuse, or unauthorized access to photos during transmission.

5. EU AI Act Compliance

In accordance with the European Union Artificial Intelligence Act (EU 2024/1689):

  • The Service uses AI systems that generate outputs based on statistical patterns. Results are probabilistic estimates, not factual determinations about a person.
  • The Service does not constitute a high-risk AI system under Article 6 of the EU AI Act. It is not used for critical infrastructure, law enforcement, migration, justice, or any purpose listed in Annex III.
  • The user (you) bears full responsibility for how the outputs are used. We expressly disclaim any liability for decisions made based on the Service's outputs.

6. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to reverse-engineer, decompile, or extract the source code of the Service; (c) use the Service to build a competing product; (d) upload photos of individuals without their informed consent; (e) attempt to overwhelm, disrupt, or abuse the Service infrastructure. We reserve the right to terminate access for any violation of these Terms.

7. Intellectual Property

The Service, including its code, design, algorithms, and visualizations, is owned by Raily LLC and protected by applicable intellectual property laws. You retain ownership of any data you submit. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF DEALING. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RAILY LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED ONE HUNDRED QATARI RIYALS (QAR 100).

10. Indemnification

You agree to indemnify, defend, and hold harmless Raily LLC and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any other person or entity; (d) any content you submit through the Service.

11. No Refunds

The Service is provided free of charge. There are no fees, subscriptions, or paid tiers. Accordingly, no refunds are applicable. If the Service introduces paid features in the future, separate terms will govern those features. All use of the Service is at your sole risk and expense.

12. Termination

We may suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including without limitation if you breach these Terms. All provisions of these Terms which by their nature should survive termination shall survive, including ownership disclaimers, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Qatar, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Doha, Qatar. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the revised Terms on the Service. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
